This Terms of Service and Privacy Policy (the “Policy”) explains how Koch Ford Lincoln Sales Ltd. and its related dealerships and websites (together, “Koch,” “we,” “us,” “our”) collect, use, disclose, and protect personal information, and the terms that apply when you use our websites, forms, and online services.

This Policy applies to our websites and services, including online inquiries, live chat, SMS/texting where offered, finance applications, service scheduling, parts requests, trade-in and appraisal tools, deposit tools, inventory browsing, and event registrations.

We are an Alberta motor vehicle business and operate in Alberta, Canada. Our privacy practices are intended to comply with Alberta’s Personal Information Protection Act (PIPA) and Canada’s Anti-Spam Legislation (CASL).

If a privacy breach involving personal information under our control creates a real risk of significant harm, we will follow Alberta PIPA requirements, including notifying the Office of the Information and Privacy Commissioner of Alberta (OIPC) and affected individuals as required.

10. Your rights under Alberta PIPA

Subject to limited legal exceptions, you may request access to your personal information and request corrections. Requests may require identity verification.

Our sites may link to third-party websites. We are not responsible for their privacy practices. Review their policies before providing information.

12. Website terms of use

Inventory, pricing, incentives, payments, availability, and trade values shown online may be estimates and may change without notice. Final terms are confirmed in-store or through finalized paperwork.

To the fullest extent permitted by law, Koch is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our sites or services. Our total liability for any claim relating to the sites is limited to the amount you paid to us online for the specific transaction giving rise to the claim, if any.

14. Governing law

This Policy is governed by the laws of Alberta and applicable federal laws of Canada, and you agree to the exclusive jurisdiction of the courts in Alberta.

We may update this Policy from time to time. The “Last updated” date shows the latest revision. Continued use of our sites means you accept the updated Policy.
